Welcome to the Empowering Ummah Foundation ("EUF", "we", "our", or "us"). These Terms and Conditions of Use ("Terms") govern your access to and use of our website, platform, and associated services (collectively, the "Platform"). By accessing, browsing, or donating through the Platform, you acknowledge that you have read, understood, and irrevocably agree to be bound by these Terms.

1. Acceptance of Terms & Legal Capacity

By utilizing the Platform, you represent and warrant that you possess the legal capacity to enter into binding contracts under the Indian Contract Act, 1872. If you are representing a corporate entity, you warrant that you are authorized to bind such entity to these Terms. If you do not agree to these Terms, you must immediately cease usage of the Platform.

2. Regulatory & Compliance Framework

EUF operates as a registered public charitable trust in India. All transactions, donations, and engagements through this Platform are subject to domestic legislation, including but not limited to the Income Tax Act, 1961 (specifically Sections 12A and 80G), the Prevention of Money Laundering Act, 2002 (PMLA), and the Foreign Contribution (Regulation) Act, 2010 (FCRA). You agree not to use the Platform for any activity that contravenes domestic or international law.

3. Intellectual Property Rights

All materials displayed or performed on the Platform, including but not limited to text, graphics, logos, tools, photographs, images, illustrations, audio, video, and animations ("Content"), are the exclusive property of EUF and/or third parties and are protected by Indian and international copyright and trademark laws. You shall abide by all copyright notices, information, and restrictions contained in any Content accessed through the Services. Reproduction, modification, distribution, or storage of any Content without prior written permission from EUF is strictly prohibited.

4. Indemnification

You agree to defend, indemnify, and hold harmless EUF, its trustees, officers, employees, volunteers, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:

  • Your use of and access to the Platform;
  • Your violation of any term of these Terms;
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
  • Any claim that your use of the Platform caused damage to a third party.

This defense and indemnification obligation will survive these Terms and your use of the Platform.

5. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall EUF, its trustees, affiliates, agents, or licensors be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, that result from the use of, or inability to use, this Platform. Under no circumstances will EUF be responsible for any damage, loss, or injury resulting from hacking, tampering, or other unauthorized access or use of the Platform.

All impact metrics, financial ledgers, and reporting provided on the Platform are estimates for transparency purposes and do not constitute statutory financial advice or guarantees.

6. Third-Party Links & Services

The Platform may contain links to third-party websites or services (e.g., payment gateways) that are not owned or controlled by EUF. EUF assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that EUF shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of such external content or services.

7. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be subject to the exclusive jurisdiction of the competent courts located in [Your City/State], India.

8. Severability & Waiver

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect and enforceable.
